  7. PLEASE READ THIS SOFTWARE END USER LICENSE 
  8. AGREEMENT "LICENSE" CAREFULLY BEFORE USING 
  9. THE SOFTWARE.  BY USING THE SOFTWARE, YOU 
  10. ARE AGREEING TO BE BOUND BY THE TERMS OF 
  11. THIS LICENSE. IF YOU DO NOT AGREE TO THE TERMS 
  12. OF THIS LICENSE, DO NOT USE THIS SOFTWARE.

  14. GRANT OF LICENSE.  Ezone grants you the nonexclusive right 
  15. to copy the Tremors animations and images on this disc onto your 
  16. computer hard drive and to use the Tremors animations and 
  17. images images and any derivatives or copies (collectively, the 
  18. "Tremors") on one computer and with one user at a time.  The 
  19. Tremors may be copied, modified and incorporated in materials 
  20. for personal or for internal company use and in website, 
  21. advertising and promotional materials for yourself or your clients. 
  22. Any website, advertising or promotional materials containing the 
  23. Tremors shall not be used to promote a website which contains the 
  24. Tremors or to promote a business that provides the Tremors to its 
  25. customers. For example, you may not use the Tremors or "Ezone" 
  26. to advertise your website business if you are providing the 
  27. Tremors to your customers. The Tremors may not be sold and may 
  28. not be incorporated in products for sale. For example, you may use 
  29. the Tremors in a website for one of your clients, but you may not 
  30. sell copies of the Tremors themselves. You may not copy this disc 
  31. in its entirety.

  33. ADDITlONAL RIGHTS AVAILABLE. If you are unsure of 
  34. your rights under this agreement or wish to use the Tremors in a 
  35. manner not permitted by this agreement, such as in products for 
  36. sale, please contact Ezone for information and additional licensing 
  37. options at licenses@ezone.com.

  39. WARRANTIES. Ezone warrants that it has the right to grant this 
  40. license to you. Ezone warrants this software to be free from 
  41. defects in material and workmanship for 30 days from delivery.  
  42. Your sole and exclusive remedy for a breach of these warranties is 
  43. the replacement of the software or refund of the purchase price at 
  44. Ezone's option. Ezone makes no other warranty, express or 
  45. implied, including. without limitation, any implied warranties of 
  46. merchantability or fitness for a particular purpose. Some states do 
  47. not permit the exclusion of implied warranties and you may have 
  48. other rights which may vary from state to state.
  49.  
  50. GENERAL. All rights in this software and the Tremors are owned 
  51. by Ezone and its licensors and are protected by United States 
  52. copyright laws, international treaty provisions and other applicable 
  53. laws. You may not use the Tremors or Ezone name except as a 
  54. credit or copyright notice with the Tremors. You may be held 
  55. legally responsible for any copyright infringement that is caused or 
  56. encouraged by your failure to abide by the terms of this agreement. 
  57. Ezone retains all rights not expressly granted by this agreement. 
  58. This software is licensed only to you. The license granted under 
  59. this agreement may not be transferred without the prior written 
  60. consent of Ezone and will terminate automatically without notice 
  61. from Ezone if you fail to comply with any provision of this 
  62. agreement. Upon termination, you must stop using the disc and the 
  63. Tremors and must return the disc and all copies of it to Ezone 
  64. immediately.
